My husband & I purchased a Spring Air memory foam for quite a bit of money several years ago & love it. However there appears to be a cave in on one side of the bed. A defect that should be covered. When we contacted Rothman Furniture to inquire about the extended warranty we purchased from them on top of mfgrs. warranty-we were told that Spring Air went out of business several months ago-call this #. Spoke with Vicky who emailed forms to fill out & when I mailed in $50 delivery charges-that the company who purchased Spring Air would cover & process warranty claims-no prob. Husband took off whole day work today expecting somewhat even exchange of matresses-only to see that the $1500 mattress we originally purchased was being replaced with a $200 mattress that had no memory foam on it whatsoever. We could only laugh at this point-as well as the delivery guy from Rothman when he saw our expensive memory mattress-he even exclaimed, "Mam, there is no way I would swap this for that-there must be a problem somewhere." This was his last delivery at 6 pm yesterday & of course when he put Rothman rep on phone-cust. service was gone for the day. My question to you all-is what would you do? What is my legal recourse-if any?
Spring Air was bought by an investment group, just before they were about to declare bankruptcy...in the middle of 2009.
Before going through the trouble of contacting the Attorney General and the Department of Consumer Affairs, you should call the store where you bought it first and give them an opportunity to rectify your problem.
